SUPREME COURT HEARING CONCLUDED On 14 and 15 October, seven Justices of the UK Supreme Court heard our appeal against the Attorney General. After years of fighting for a proper investigation into my brother Geoff’s death, we have reached the country’s highest court. So what actually happened? Our legal team, led by Nicholas Bowen KC, challenged the claim that the Attorney General’s refusal to allow us to apply for a fresh inquest is immune from judicial review. A central argument concerned Gouriet, a House of Lords decision from 1977. The Attorney General relies on that case to defend immunity. We argued that it concerned a different legal procedure and should not prevent courts from reviewing decisions about fresh inquests. If it does require that result, we argued that the Supreme Court should depart from it. The Justices questioned both sides about the consequences. In one striking exchange, they tested whether the Attorney General’s position would prevent judicial scrutiny even if a decision were made by rolling dice. Counsel for the Attorney General accepted that this was a consequence of treating the decision as unreviewable. That was a hypothetical example, but it exposed the principle at stake: can this power really sit beyond the courts’ supervision, however arbitrarily it might be exercised? The Court also explored whether political considerations, including international relations, could justify refusing access to a fresh inquest. Our team pointed out that no separate political justification had been identified in our refusal: the reasons concerned the evidence and the prospects of a fresh inquest being ordered. There was also an important clarification. If the Court rejects immunity, the Attorney General accepted that the usual grounds of judicial review would apply, rather than restricting challenges to dishonesty, bad faith or exceptional circumstances. However, he argued that the courts should take a highly restrained approach. Our case is that proper respect for the Attorney General’s judgment must still allow courts to correct legal errors. We asked for our case to return to the High Court so that permission for judicial review can be considered. The Attorney General maintained that permission should be refused even if we succeed on the constitutional issue. That matters. We need a ruling that gives our challenge a practical way forward. The questions were searching on both sides. We have put our arguments before the Court; the decision is now theirs. Judgment has been reserved. We expect it in the New Year, although no date has been announced. Winning this appeal would not itself secure a fresh inquest, or automatically grant permission for judicial review. It could remove the immunity barrier and allow us to pursue the next stage. Behind all these legal arguments is a straightforward purpose: a full and proper investigation into how Geoff died.
