This is a good time to remind California voters of current election law.
The question below was recently posed to @CASOSVote. Lacking a truthful response, I have provided the answer.
Question: Do registered voters in California elections need to be US citizens or can anyone in California who’s registered to vote be eligible to vote?
Answer: U.S. citizenship is required. In California, you cannot legally register or vote in state or federal elections unless you are a United States citizen.
Being a California resident and being on the voter rolls is not enough.
State law is explicit. California Elections Code section 2101 says a person entitled to register must be a United States citizen, a California resident, at least 18 on Election Day (16–17 to pre-register), not currently serving a state or federal prison term for a felony, and not found mentally incompetent to vote by a court.
The Elections Code and the California Constitution also state that voters “shall be citizens of the United States.” Federal law separately bans non-citizens from voting in elections for President, Vice President, or Congress.
When you register, you must check a box affirming U.S. citizenship and sign under penalty of perjury. California does not currently require documentary proof of citizenship (passport, birth certificate, etc.) to register.
That is a separate issue from the legal eligibility rule itself. A pending November 2026 ballot measure (Proposition 39) would add ID and citizenship-verification requirements if voters approve it; it has not changed the law as of today.
Narrow local exception: San Francisco (and at times Oakland) have allowed certain non-citizen parents, guardians, or caregivers to vote only in school-board elections. That does not apply to governor, legislature, Congress, President, or other statewide or federal contests.
So: anyone who is registered is supposed to be a U.S. citizen.
Non-citizens are not eligible to vote in California’s regular elections even if a registration error put them on the rolls. Voting while ineligible is a crime under both state and federal law.
