A SCOTUS litigator tells me Jan 8 is the date to watch when it comes to the Kalshi case—that's when we'll know if we'll get a decision by June
Interviews like this are why I love being a reporter. It's such a privilege to speak to smart, accomplished people in different fields

There are strong bicameral discussions on this issue and Chairman Smith and @RepHorsford have advanced a thoughtful proposal. I am especially pleased that it includes our legislation to fix the gaming losses tax that has harmed Nevada.
Certainty for taxpayers with digital assets is an important issue, and I look forward to working with my colleagues in the Finance Committee on bipartisan solutions.
I commend Senator @SteveDaines for introducing the Aligning Digital Assets with Principles of Taxation Act.
This bill has much in common with the Digital Asset Tax Certainty Act, which passed out of the Ways and Means Committee on a strong bipartisan vote. There is also clear momentum building to deliver tax certainty to digital asset owners and ensure America remains the crypto capital of the world.

Replying to @DataBasedBets @SteveDaines
The crypto bill is the right vehicle because its revenue raisers cover the cost of repealing the cap. The Senate text leaving it out means it has to be won in negotiation, not that it's dead. The final text needs Title VII, effective for 2026.

Washington Republicans’ “One Big Beautiful Bill” changed the gambling tax deduction and will force players to pay taxes on money they’ve LOST. We must reverse this unfair tax that is hurting Nevada’s economy, and we’re one step closer to getting it done now that our bill has passed out of committee in the House.
I’ll continue working to pass it in the Senate to repeal the tax on losses and protect Nevada’s tourism economy.
My FULL HOUSE Act just passed through committee after more than a year of fighting to get this done for Nevada.

This is great news. I have been grateful to work with @RepHorsford on our legislation to stop unfair taxes on gambling losses – money that, by definition, taxpayers don’t have – and this is a key step forward to getting it passed into law.
The FULL HOUSE Act will help Nevada’s gaming and tourism industry and support workers across our state. Let’s get it done.
My bipartisan FULL HOUSE Act has passed through committee, bringing us one step closer to restoring the full gambling loss deduction that I have been fighting for over the past year.
This is a major step forward for Nevada, our gaming economy, and the workers and families who depend on it. People should not be taxed on money they never actually earned.
I will keep fighting to get this through the House and signed into law.

Finally, after 14 months of uncertainty, my fix to restore the 100% tax deduction for gambling losses has been passed out of committee.
I was the first Member of Congress to recognize this injustice when I introduced my provision to correct it on July 7, 2025. Since then, I have amplified this issue nationally and brought it to the attention of my colleagues, including members of @WaysandMeansGOP.
Now it is time for us to push this commonsense solution to the House floor, to the Senate, and finally to the President’s desk. I won’t stop fighting until we get this over the finish line.

Breaking: the big tax bill with a provision to repeal the 90% cap on gambling losses was just overwhelmingly voted through, with bipartisan support, to the House Rules Committee. It’s a technical step before it goes to the House floor for a full vote.
The 90% cap on gambling losses would be repealed retroactive to 1/1/26 as part of the Ways & Means tax bill.
Joint Committee on Taxation estimates a negative impact on revenue of $2 billion from ‘27-36 from this repeal.
The ‘27-34 estimate is $1.5 billion, up 33% from its $1.1 billion estimate during same period.
Wonder if this means estimated tax payments from gamblers were higher than anticipated?

My FULL HOUSE Act is getting marked up in the Ways and Means Committee this Wednesday.
Nevadans should not be taxed on income they never actually received. But a mistake added by Senate Republicans last year means you can be taxed even when gaming.
My bill is the only real solution to fix this, and I’m glad we’re moving forward. Nevadans need this fixed, and I’ll get it done.

Kalshi is about to lose zillions over this Michigan game. Cant change settlements per CFTC rules and they graded Western as a win. Going to have to manually pay all Michigan traders and not take away from Western traders

The IRS spent today telling bettors to stay on licensed books and report everything.
The licensed book sends a W-2G. The offshore book sends nothing. And in 2026 the 90% cap can hand a breakeven player a tax bill on money he never kept.
You cannot run a compliance campaign and a phantom income tax at the same time.

I think this is the biggest story of the week in a week that has already been massive.
This changes the calculus for companies like Novig, SIG, and others who rely on the trading arm as much as the commission structure.
Incentivizes PMs increasing commission on MM's. As a very smart bettor once told me "you can't have MM's making more than PM itself. That's unsustainable."
CFTC Rule Proposal: In-House Market Makers Allowed, But They Can’t Take A Side
Affiliated market makers — entities that share ownership with an exchange they trade on — can exist, but only if they act as “bona fide” market makers and do not take directional positions on one side of a market or another, the CFTC proposed Thursday.
