Make it illegal to work, then start carving out exceptions for people with clout.
Look at how many professions (which seem to include freelance writers and editors like me) the Senate Labor Committee Chairman now wants to protect from the ABC Test rule After NJDOL and Governor Sherrill just told us all that nothing changed and we don't have to worry

Lede: “Who should cover the costs of climate change?” Answer: It won’t be oil companies. Sue an entire industry and consumers pay. Easier to tax, but then no fees for private lawyers. nytimes.com/2026/10/05/us/po… via @NYTimes

.@for_consumers's Executive Director O.H. Skinner III on what would happen if SCOTUS were to rule against Suncor: “If there is a loss for the energy companies, you will start to see a greater use of nuisance, not just in the climate context, but in the control of people’s lives context. How do you get rid of plastic straws? You bring a public nuisance claim... They’ll pursue greater and greater claims against guns, everybody in the value chain of energy... [then utilities, car manufacturers] and it will work all the way down the value chain in an effort to sort of fundamentally reshape the economy.”

The signs left it to the person reading the sign “to determine what his or her ‘own risk’ is,” a plaintiff expert said. Because no one can do that without help.

Feature not a bug. Independent workers are always a problem for big organizations. Regulate them out of existence.
“Michael Edwards, senior vice president of carrier insurance broker Gallager, said there's little scope for a motor carrier using an owner-operator driver to avoid violating the [ABC] test's B prong since it looks at whether a worker is performing a service outside of an employer's normal course of business. "The B prong is impossible to avoid,” Edwards said. To comply with the law, an owner-operator would have to start carrying their own liability insurance instead of being under the motor carrier’s existing coverage, Edwards said. Insurance premiums to cover a single owner-operator’s truck would be much higher than for a larger pool of trucks under a motor carrier, if coverage could be found. “That would be a nightmare,” Edwards said. “Insurance costs would triple.” joc.com/article/ny-nj-port-t…

Because why should taxpayers know how their money is going to be spent? Sher Edling’s contract with New York City. (Yes all money recovered in a lawsuit belongs to the client first)
