最高行政法院今日判決，內政部的命令要求跨性別者必須先完成摘除性器官的變性手術，方可申請變更性別登記，違反了法律保留原則與比例原則，不應採用。法院表示，申請人只需證明自我感受之性別歸屬與出生登記之性別相衝突，並持續相當時日，即可變更性別登記，而無需摘除性器官。最高行政法院將本案發回重審，要求原審考量申請人所提出的證據，判斷其性別認同是否趨於穩定。
