In response to multiple inquiries from fans, we wish to clarify the following: An analysis based on our inquiries into the legal and institutional framework behind the recent cafe wiretapping incident involving Sergeant LEE DONGMIN, widely known as CHA EUNWOO, reveals clear jurisdictional boundaries between civilian law enforcement and the Ministry of National Defense (MND). When a crime takes place in a civilian establishment, primary jurisdiction falls strictly under civilian law enforcement. In this case, because the unauthorized recording device was placed inside a public venue in Yongsan, Seoul, the Yongsan Police Station is leading the criminal investigation. Law enforcement authorities are currently conducting digital forensic analysis on the suspect’s phone and seized hardware to trace the origin of the eavesdropping equipment, establish intent, and identify potential co-conspirators. Although civilian police retain investigative authority over offenses committed in public spaces, the Ministry of National Defense plays an active secondary role whenever a victim or targeted party is an active-duty service member like Sergeant Lee. Military authorities maintain direct communication with civilian law enforcement to monitor case progress. Beyond statutory legal proceedings, the Ministry holds an administrative duty to ensure the personal safety and security of active personnel during their term of service. This obligation allows military leadership to implement enhanced force-protection measures, perform technical security sweeps, and provide official support to protect service members from external threats. The division of responsibility shifts fundamentally based on where an offense occurs. Had the same act occurred on military property—such as inside a garrison, administrative building, or defense facility—it would trigger immediate military jurisdiction. Under those circumstances, the Defense Criminal Investigation Command and the Military Police hold exclusive authority to initiate independent criminal proceedings, conduct searches, and process charges through the military judicial system. Because the incident occurred off-base, civilian criminal statutes govern the immediate prosecution of the suspect, while defense authorities focus on operational security and personnel protection for Sergeant LEE.
