"I have the gravest concerns that the Standards Commission is not acting compatibly with the law of free speech in the UK. I do not know if this is because it does not understand the law or if it understands it perfectly well but for some reason declines to apply it." -Prof Tomkins, Constitutional Law @heraldscotland

Robust FoI legislation enables the public 2 separate fact from fiction - if something doesn’t sound or read right, they can make an information request & enforce the right thru regulators. FoI reform must be core 2 Govt strategy @KatySClark @jamiehepburn

Increasing demand…increasing transparency…
Our new annual report shows that, while FOI appeal numbers have rocketed, our small team is working hard to close more cases and help people get the information they need.

Following on from @heraldscotland's coverage of hybrid working in the civil service, a trade union told the Scottish Government their emails and letters couldn't be issued under FOI unless they had given prior "agreement".

I've written to the President of Employment Tribunals Scotland and the allocated judge in the upcoming case of Peggie v Royal College of Nursing raising concerns about open justice:
With rising appeals & insufficient funding 4 the Commissioner’s office, it’s disappointing to learn that time & expertise needs to be spent on an appeal because a L/a did not bother 2 search 4 info relating to the request as “no reason to believe the info should be held”. Dismal!
New decisions from the Scottish Information Commissioner find Dumfries and Galloway Council "failed at the most basic level" in its handling of FOI requests relating to a local flood prevention scheme. Read more: zurl.co/Pe4zw

🔴 UPDATE: The Standards Commission have finally disclosed their legal fees. £40k of public money achieved this judgement against them:
• Unlawful evidence exclusion
• Lack of internal logic
• Overstated its legal powers
• their guidance written so vaguely it could mean almost anything they want

🚨Warning: 83% increase in appeals in one year - and tracking even higher this year. Delighted that people are using their info rights but this level of demand on my office is unsustainable without additional resourcing.
In our latest Annual Report, published today, Scottish Information Commissioner David Hamilton warns of a risk to the effective enforcement of FOI in Scotland following a significant rise in appeals over the last year.
