This piece was an invited contribution to a forthcoming symposium on the next wave of thinking about government’s use of AI.
To restore democratic accountability & keep human judgment in control (1) Congress needs to pursue sensible disclosure reqs for AI tools in rulemaking & (2) courts should soften the presumption of regularity to permit targeted discovery on agency use of outside helpers for rules.

And here's my contribution! There are plenty of good use cases for AI to help with government decisionmaking, but sometimes we need to say no. It seems like it’s harder than it should be to say no right now. The language we use might be one part of why.
