Bridget Phillipson's assurance that 'refusing to accept a child's identity' will not be prosecutable under conversion practices legislation is contradicted by the bill itself, which says that 'psychological or emotional pressure' with the intention of changing 'transgender identity' could qualify as a criminal offence. How can Phillipson know how a court will interpret 'refusing to accept a child's identity' given the vague and open-ended definitions in the bill? An op-ed by a politician will be scant consolation when a parent is facing a criminal claim or a protection order that will destroy their relationship with their child. And the question remains: what 'abuse' is the bill designed to tackle that is not already an offence in law? archive.ph/BDRJN

An impact assessment which misses so many of the points @soniasodha has made is an impact assessment in name only. If the #ConversionPracticesDraftBill becomes law Labours legacy will be of overarching incompetence & deliberate blindness to facts. @andyburnham #BinTheBill
These safeguards are nowhere near as robust as presented here: 1. The acts don't need to cause physical or psychological harm - they can also simply cause serious alarm or distress that has a substantial adverse effect on usual day-to-day activities - much more subjective.

Safe and effective care for gender-distressed children and young people will only be achieved when clinicians, policymakers and researchers are prepared to acknowledge and address the serious shortcomings in the diagnostic frameworks. Following its recent consultation, the National Institute for Health and Care Excellence (NICE) admits that stakeholder feedback highlighted extensive limitations with the diagnoses of gender dysphoria and gender incongruence (DSM-V and ICD-11). Sadly, that feedback is ignored in NICE's recommendations, where diagnostic limitations do not even warrant a mention. Instead, NICE continues to use these flawed diagnostic labels as the basis for recommending risky medical pathways. NICE recommends: "long-standing gender incongruence should be an essential pre-requisite for medical treatment", albeit with the concession that this should be "only one aspect of deciding whether a medical pathway is the right option for an individual". What NICE fail to ask is whether a diagnosis of gender incongruence offers any value at all in making such a decision. This is especially puzzling since the Cass Review emphasised that "Although a diagnosis of gender dysphoria has been seen as necessary for initiating medical treatment, it is not reliably predictive of whether that young person will have longstanding gender incongruence in the future, or whether medical intervention will be the best option for them." The lack of predictive power for gender dysphoria applies equally (arguably even more so) for a diagnosis of gender incongruence. NICE offers no explanation as to why a diagnosis of gender incongruence is deemed necessary (albeit not sufficient) before embarking on puberty blockers or hormones. No information at all is provided about the additional "aspects" that supposedly enable a decision that "a medical pathway is the right option". The basis for decision-making is thus a flawed diagnosis plus unspecified other factors. Indeed, this is exactly the model being followed by KCL PATHWAYS in the puberty blocker trial.

I question and dispute as sincere or ethical, the confidence (described in Orlando's article below), that the MHRA PB trial will possess a means to 'readily differentiate' GD from AGP children through clinical inquiry. In any area of psychological assessment,to establish something specific, one may indeed 'inquire', but may also receive answers nowhere near the true picture, subsequently borne out by developments/behaviours/actions/outcomes etc. The confident claims that one may distinguish GD from AGP in children, to me demonstrates either that they haven't worked much with this young client group and/or don't really understand that pubescent boys can't or won't always have the answers to the questions they are asked. So much of psychological/MH assessment work, is not about obtaining instant answers providing tidy clarity - unless the patient is at a stage where they recognise something themselves and are able to be open and answer questions of an intensely personal nature. One might assess a child and develop a view they do/don't have symptoms/behaviours which might provide clinical clues, but this is not necessarily fixed or an exact science. It takes time to understand. Many children are struggling to even know themselves, let alone admit anything to adults. Both GD and AGP are attempts by the mind to deal with psychological trauma of some sort. Neither will be 'cured' by pharmaceutical interventions. I strongly contest the MHRA claim that this issue is so easy to address within the protocols of the PB trial. Some of the kids who seek refuge in trans identification are just quirky, offbeat types who come to focus on feeling that they do not fit in. They are often "creatives" who take naturally to the project of redesigning the way they present themselves. Please remember them too.
So where were all the transchildren before 2014? Were they subject to genocide, or perhaps forced to live in their wrong body? Or perhaps they were called tomboys, butch, gender non conforming, effeminate, gay, autistic? And then grew up to be healthy fulfilled adults?

What I see a lot in trans-id people is a lack of insight into shame and guilt. And zero gratitude. These are basic skills we have somehow absolved them from.
