But there is a glaring omission in that argument: that case was decided before Eby himself introduced the Interpretation Amendment Act, 2021 (Bill 29). It was Eby's own Bill 29 that added an explicit, mandatory direction to B.C.’s legislation: “Every Act and regulation must be construed as being consistent with the Declaration.” While the 2020 case dealt with non-binding international instruments on their own, British Columbia explicitly chose to give UNDRIP an express, binding role in interpreting provincial law. By anchoring his entire case to a pre-2021 precedent, Eby is exposing British Columbia to an immense legal risk. He is gambling our province's economic future on a case that completely ignores his own subsequent legislation. If the Supreme Court rejects this outdated argument and rules that DRIPA and Bill 29 mean exactly what they say, Eby will have locked in the very legal chaos and investment paralysis he claims he wants to avoid. So if Eby is now claiming the courts have taken DRIPA and Section 8.1(3) of the Interpretation Act further than his government ever intended, it raises an obvious question at the heart of this highest-court appeal: Why is he risking an adverse Supreme Court of Canada ruling to narrow the meaning of wording his own government enacted, instead of returning to the Legislature to clarify the wording directly? His government deliberately deferred amendments in the spring, openly acknowledging that crippling economic uncertainty remains. If the Premier truly believes the law is producing consequences the Legislature never intended, he needs to stop asking judges to fix his own bad drafting. With a snap election looming, British Columbians cannot afford to be left in a state of unresolved legal chaos. Premier Eby must immediately recall the House for October 5. Stop passing the buck to the Supreme Court of Canada, table the amendments, face the Legislature, and do the work!!!!

When Nutrien looked to build a massive, new West Coast potash export facility, they took one look at the hostile regulatory minefield Eby engineered and chose Washington State instead. We lost the jobs. We lost the revenue. Now, with a sudden snap election looming and his political survival on the line, Eby desperately wants British Columbians to forget his own legislative record and believe he’s the guy standing up for Canadian resources. It is naked, cynical hypocrisy. We absolutely must fight for Canadian potash and protect our workers. But the way to do that is by aggressively building the infrastructure, pipeline capacity, and export redundancy that make our resource industries unbreakable. You cannot spend years systematically weaponizing the provincial legal system to destroy resource investment at home, and then reinvent yourself as an economic patriot the second it becomes politically convenient. British Columbians see right through the desperation, and our resource workers won't be fooled by a cynical, snap election conversion.
