In June 2025 they did something almost nobody noticed. On June 4, 2025, USCIS issued policy guidance tightening the TN “Engineer” category. A computer science or generic IT degree is no longer enough to enter as an Engineer. The degree has to be a bona fide engineering discipline, or the applicant needs a professional engineering license. Officers now apply a four-part test, including degree match and duties match. The job title on the badge does not determine eligibility. The credentials and the actual work do. This was not a mass bust. It was just a simple sentence in the manual. The guidance applies to petitions and applications filed on or after June 4, 2025. Nobody was yanked out of a cube the next morning. Existing TN holders keep current status until it expires or are reported as not competent for their roles. The hard cliff is at renewal and at the port of entry. People who previously slid in as “Engineer” with a CS degree are now getting denials when they try to come back in the same category. Some companies are attempting to shift those workers to Computer Systems Analyst. Some are chasing a PE license. Some are finding out the workaround does not hold. Few are bringing attention to the fact that they have a job they are not qualified for. That is the official admission. The occupation was being used as a dump category for technical work that American STEM graduates were trained to do. If you work next to someone in a visa role who cannot do the job, cannot communicate at the level the work requires, or is sitting in an Engineer title without an engineering degree, that is not office gossip. That is a classification and competence problem. H-1B employers attest that the worker is qualified for the specific role. TN Engineer now requires a real engineering credential. When the person in the seat fails that test, the system is being used to hold a job an American graduate should have been considered for first. As three year renewals pop up- they are having to exit their employment and make plans to return back home. You can report those who are not qualified for their position who show clear deficits in ability.
