.@USCIS has issued updated guidance on the H-1B Procolomation on their website (uscis.gov/working-in-the-uni…)
I respectfully disagree with Judge Reyes here.
I’ve seen plenty of woods and water fronts thanks to golf!

DOI deputy chief Greg Wischer, testifying about his knowledge of Trump's plans for the golf course, admits he's not a golfer.
"Me neither," Reyes responds. "A good walk ruined."
Here is the thing I’ve learned being in Judge Reyes’ court. She isn’t summoning government officials just to swing her power around. In the hearing @BaniasLaw and I had with her, she asked DOJ for an answer. They couldn’t give it so she told them to get ICE counsel. They didn’t have an answer because the decision was made above them. So she said she’d keep going through the chain of command until someone could provide simple answers to basic questions.
The issue with the current administration is that they are executing things at the top, and then get indignant about being asked about those (many times unlawful) decisions.

There it is:
Trump Admin objects to judge’s order that a top appointee of Interior Secretary Doug Burgum testify about the toppling of 100s of trees at East Potomac Park in DC
Admin didn’t draw the line when it was civil servants being questioned

BREAKING WaPo:
Trump officials scrutinized Rep. Ilhan Omar in 2019. They didn't find citizenship issues.
The earlier review of Omar's immigration records looked at many of the same issues being investigated now. washingtonpost.com/national-…
While the job posting is absurd and shows USCIS has no intent to follow its Congressional mandates, there is some humor in it.
For example, an ISO job posting on USAJobs.gov shows the position "requires no college degree." While I do not personally think a college degree is the end-all be-all of anything, it is funny when we see some of the stuff USCIS sends on EB-1As, NIWs, and O-1s, and others. Individuals who are some of the top tier in the world (or close to it) are seeing pushback from a role that "requires no college degree."
18 U.S.C. § 922(g)(5)(B) prevents lawful nonimmigrants from owning a gun unless it’s for hunting. I’m not sure how that is still constitutional given the current jurisprudence of 2A.
Either way, not allowing people to protect themselves is absurd and the statute should be repealed.
Reminder, even though the administration is starting this with all sorts of political pretext, this requires them to prove their case in an Article III court in front of a real judge, not one of their crony immigration “judges”
BREAKING WSJ:
The Trump admin's investigation into Rep. Ilhan Omar is aimed at building a case to strip her of her U.S. citizenship and ultimately deport her, according to U.S. officials and other people familiar with the probe. wsj.com/politics/policy/ilha…

DHS claims its rule won’t affect denials. But after the same policy (no deference) in Trump’s first term, the denial rate for H-1B petitions for continuing employment rose 140%, from 5% in FY 2017 to 12% in FY 2018 and FY 2019. @David_J_Bier @gsiskind forbes.com/sites/stuartander…

In this admin, you're supposed to charge $100k to the Visa, not Amex. 🥁

So this regulation for USCIS benefits is just going to go back and forth between administrations isn’t it?
Deference helps efficiency in the agency when there is no change in a benefit request.
DHS plans to axe a policy deferring to prior approval for H-1B workers when employers file extension requests.

UC Berkeley’s international office has announced plans to oppose an ICE proposal that would require colleges and universities to pay a $70,000 fee before recommending a foreign student for Optional Practical Training work authorization.
Berkeley International Office told students in an Oct. 7 email that the proposal has not taken effect and current OPT procedures remain unchanged.
ICE argues that the required fee could combat immigration fraud and protect U.S. jobs by incentivizing universities to scrutinize OPT applications more carefully.

Judges must stop trusting the government.
Replying to @kyledcheney
REYES on a tear: "I was hearing from everybody on plaintiffs side that this was going to happen. I said repeatedly no, I trust the government. I trusted you all not to do precisely what you have done. Not only does that make it inexcusable ... I am just at a total loss to understand what has happened here, other than — Occam’s razor time — that the government precisely intended to do precisely what it has done, which is intentionally delay letting the pantiffs and the court know what is happening so they can put a plan in place to clear hundreds and hundreds of trees."
Having been in Judge Reyes’ proceedings, she won’t let either party weasel their way out of things. Would hate to be on the wrong side of it.
But, good thread on how DOJ leadership is ruining DOJ reputation in courts. It will take a long time to repair the damage.
Ugh. @immigrationgirl we’re going to have to update our forms software for this totally real program that totally exists!
Employees can and do often transfer companies for better opportunities. And with the unfortunate state of the green card backlog, many that I’ve worked with are not overly concerned once their I-140 is approved.
Can also just end the green card backlog!

If one believes the terms of the H-1B visa amount to indentured servitude, pausing permanent residency applications for thousands of such visa holders (who would be able to work anywhere and for anyone with a green card) is, in practice, an expansion of indentured servitude.
