This is my plain-language interpretation of the Help America Vote Act (HAVA), the National Voter Registration Act (“Motor Voter”), and the related federal voting laws discussed above. FEDERAL VOTING LAWS, EXPLAINED SIMPLY Federal law already has penalties for false voter registrations, unlawful noncitizen voting, and intentionally helping someone commit those crimes. Election officials can be charged, too. Here is what those laws say in plain English. WHAT MOTOR VOTER AND HAVA REQUIRE Motor Voter, passed in 1993, helps eligible people sign up to vote through places such as the DMV. The registration form must explain citizenship requirements and require applicants to sign under penalty of perjury. That means knowingly lying can bring legal punishment. HAVA, passed in 2002, added safeguards. The federal mail registration form must ask whether the applicant is a U.S. citizen. Someone who answers “no” must be told not to complete the form. If the citizenship answer is missing, the registrar must contact the applicant and give them a chance to complete it, subject to state law. Registering means signing up to vote. Voting means casting a ballot. These are separate steps, and federal crimes can occur at either step. THE POSSIBLE CHARGES 1. LYING ABOUT YOUR CITIZENSHIP Law: 18 U.S.C. §1015(f) Someone knowingly makes a false claim that they are a U.S. citizen so they can register or vote. Example: A person knows they are not a citizen but checks “yes” to citizenship on a registration form. Possible penalty: Up to FIVE YEARS in prison, a fine, or both. A person can commit this offense when registering, even if they never vote. The statute includes a narrow exception involving citizen parents, childhood residence, and a reasonable belief in citizenship. 2. KNOWINGLY SUBMITTING FALSE REGISTRATIONS Law: 52 U.S.C. §20511(2)(A) Someone deliberately cheats the federal election process by obtaining or submitting registration forms they know contain important false information. Example: A worker knowingly submits false citizenship information to get an ineligible person registered. Possible penalty: Up to FIVE YEARS in prison, a fine, or both. This law expressly includes election officials. 3. VOTING IN A FEDERAL ELECTION AS A NONCITIZEN Law: 18 U.S.C. §611 A noncitizen votes in an election involving federal offices, such as president or Congress, without qualifying for a legal exception. Example: A noncitizen casts a ballot in a congressional election. Possible penalty: Up to ONE YEAR in prison, a fine, or both. This can apply to people who are here legally as well as those here unlawfully. Permission to live in the United States does not, by itself, make someone a citizen or give them the right to vote in federal elections. 4. KNOWINGLY GETTING FRAUDULENT BALLOTS CAST OR COUNTED Law: 52 U.S.C. §20511(2)(B) Someone deliberately cheats the federal election process by obtaining, casting, or counting ballots they know are false or fraudulent. Example: An official knowingly adds fraudulent ballots to the count to cheat the election process. Possible penalty: Up to FIVE YEARS in prison, a fine, or both. 5. INTENTIONALLY HELPING SOMEONE COMMIT THE CRIME Law: 18 U.S.C. §2, called “aiding and abetting” Someone deliberately helps another person commit a federal crime, or deliberately causes it to happen. Example: Someone helps prepare a false citizenship claim so another person can register illegally. Possible penalty: The maximum punishment for the crime they helped commit. This rule applies alongside the law that was broken. It does not automatically add another prison term. WHAT MUST BE PROVEN? For the two Motor Voter fraud provisions above, prosecutors must prove the person knew the information or ballots were false and deliberately acted to cheat the election process. An incorrect entry or an employee’s name on paperwork does not, by itself, prove that crime. HAVA also allows federal court action to make states correct failures to follow its election rules. Criminal punishment requires proving an applicable criminal offense.
