We deeply regret the ratification today by the Libyan Parliament of the so-called Libyan-Türkiye Memorandum of Understanding on the delimitation of maritime jurisdictions in the Mediterranean Sea.
We recall that the EU’s position on this matter was clearly stated by the European Council in 2019 and remains unchanged. This agreement infringes upon the sovereign rights of third states, it does not comply with the Law of the Sea, and is null and void.
We reaffirm our solidarity with Greece and Cyprus.
We reiterate the EU's well known position against any outside interference in Libya.

UNCLOS Art. 15 addresses territorial sea delimitation by median line subject to special circumstances, not persistent objection. That doctrine is ILC Conclusion 15: a state objecting during a custom’s formation is unbound while it maintains the objection.
Turkey has not joined UNCLOS and objects to full island effect in the Aegean. Yet ICJ jurisprudence treats Art. 121 as customary law: islands capable of habitation generate EEZ and continental shelf like mainland territory. Entitlement is separate from delimitation, which must reach an equitable result and may reduce island weight. Complete denial of island zones is inconsistent with that custom. Art. 300 binds only parties.
