Major-Questions Doctrine Could Shift Focus Back To Sports Gambling In Prediction Market Cases
My latest for Forbes.

🚨 BREAKING: Kalshi sues Louisiana in federal court, alleging state officials “will imminently bring an enforcement action” to bar its event contracts, pointing to public statements made between Dec. 2025 and Mar. 2026, amicus brief filings, and no assurances of non-enforcement.
States put themselves at a disadvantage by not filing 1st in state court. C&D letters, public statements buy an unwanted ticket to federal court, where the sole issue is jurisdiction. Merits get sidelined as preemption fight drags on—preventing state enforcement in the interim.
Not an imminent threat—but a race to the courthouse. Grab a federal case number, park the suit, and thwart state enforcement in state court. Same playbook in AZ, IA, TN & UT. Why? State court means a quick loss and an injunction.
That brings to 21 the number of states in litigation with prediction markets over event contracts. Louisiana is the first case within the deep-red Fifth Circuit (TX, LA & MS).

At #IndyFest2026, a panel is underway on the future of prediction markets.
Gaming Control Board Chair Mike Dreitzer said prediction markets are "not too big to fail. It's also not too big to regulate."
Will thread notable comments. 🧵
BREAKING: The NYS Gaming Commission has sued Kalshi in NY County Supreme Court to force compliance with subpoenas seeking records on its sports-event contracts, offerings to NY’ers under 21, ads describing its products as wagers or bets, and ownership and corporate structure.
NY says Kalshi’s ownership information is needed to identify who is responsible for potential Racing Law violations and could open new investigative avenues involving other entities and individuals.
