Today, a coalition of 100+ signatories join DEF in sending a letter to Congress.
Software developer protections are a non-negotiable in digital asset market structure legislation. This critical issue unites us — crypto and tech builders, investors, and advocates.
Always proud to work alongside the teams at @fund_defi and @a16z. This time in pushing back against the proposed rules implementing the Illinois Digital Asset Tax bill.
As a refresher, this bill would treat DEXs as brokers, mandate a tax be taken from the DEX itself. A failure of doing so would be a violation of criminal law.
Further still, the bill wrongly taxes transfers between a user's wallets and penalizes bridging and wrapping.
Worse still - as written a broker (including a DEX under the proposed rules) must keep a user's private keys. Obviously, this is a complete departure of appropriate cybersecurity and anathema to proper cryptography practices.
The case challenging the Digital Asset law itself is moving through the court and we are thankful to @BlockchainAssn, @crypto_council and @DigitalChamber for their efforts.

#ThisWeekInCrypto: Americans want more control over their money.
A new @fund_defi and @ipsosus study found that less than half trust the existing financial system. And 22% of Americans say they've owned crypto, with Republicans and Democrats within a few points of each other.
Get ready for Election Day on Nov. 3.
Americans don't believe TradFi is secure. Spooky.

“We want to be able to assist Illinois with getting this right,” DeFi Education Fund Chief Executive Officer @amandatums said. “They can re-release the rulemaking with updated content and we would be happy to help them in that process.”

Today, @a16zfrontier, @fund_defi, and @uniswap stepped into the fight against the Illinois Digital Asset Tax Act.
The law is already one of the most anti-innovation bills in the country—a tax on transactions just because they're digital.
Now, it's being made worse through politicized rulemaking that goes well beyond what the law approved—the draft rules would treat many decentralized exchanges (DEXs) as tax-collecting brokers.
That approach isn't possible to comply with: autonomous software is not a person that can collect a tax. The approach also conflicts with the U.S. Treasury Dept’s classification of DEXs and Illinois’ own Digital Assets and Consumer Protection Act.
The rules also tax Illinois resident's when there isn't even a transaction. That’s like being taxed for moving money from your checking account to your savings account.
Consumers and entrepreneurs in Illinois deserve better.
Fortunately, @CCI and @BlockchainAssn are also challenging the Act in court and will have the entire law thrown out. Until then, we must press Illinois to stop playing politics and to follow its own laws.

Illinois’ proposed digital asset tax rules could have serious consequences for DeFi, self-custody, and crypto users. Today, @fund_defi, @a16z, and @Uniswap submitted a letter urging Illinois regulators to reconsider several aspects of the proposal. Illinois should not impose obligations on software that it cannot possibly satisfy or penalize users for exercising control over their own assets. Our comments, featured in @Politico this AM, urge the Department to preserve the distinction between actual financial intermediaries and non-custodial infrastructure, protect self-custody, and align its rules with federal law. 🧵
