Miami Beach sent armed police to Raquel Pacheco’s home because she criticized the Mayor’s rhetoric about Palestinians on social media. The officers refused to leave and told her not to post such content again.
Now, a federal judge has ruled that Raquel’s First Amendment lawsuit, brought by ADC, can proceed.
VICTORY in @adc case Pacheco v. City of Miami Beach! Earlier this year, the Mayor sent police to veteran Raquel Pacheco's house because she had criticized the Mayor's dehumanizing rhetoric against Palestinians on social media.
The cops refused to leave even though she said she didn't want to speak to them without a lawyer, insinuated her post could be unlawful as it could incite violence, and told her to refrain from posting such content in the future.
Today, the judge in the Southern District of Miami DENIED much of Defendants' motion to dismiss, finding that the police visit could constitute unlawful viewpoint discrimination and retaliation under the First Amendment. The judge also held we could proceed on our theory of municipal liability against the City, because we had alleged facts demonstrating a pattern or practice of discriminating against pro-Palestine speech in the City of Miami Beach. Eyewitness to the Israeli settler attack on Palestinians and @washingtonpost photographer Heidi Levine tells me, “It was barbaric…there were maybe 5 or 6 surrounding her. They had clubs…And they were standing over her, beating her over and over, it was truly horrific. I was worried that she was going to be killed.” - @infinite_jaz
We’re grateful for these words and for everyone who recognizes the importance of this work.
From challenging government abuses to helping the growing number of people whose rights are being violated at the U.S. border, ADC’s legal team works to hold the government accountable and defend people’s constitutional rights.
This work is only possible with your support: adc.org/donate/
I want to take a moment to express my appreciation for @JeninYounesEsq and the incredible work she and her colleagues at the @adc do to protect people from government abuses.
When CBP seized journalist Max Blumenthal’s devices, Jenin helped secure their return in less than 24 hours and is now pursuing legal action demanding greater transparency and accountability.
But her work isn't limited to prominent journalists or public figures.
Jenin had never even met me, yet she took the time on very short notice to assist me when I was traveling through CBP.
More recently, she helped another friend whose family was detained at an airport and had their devices seized.
These are just a few examples of the countless people she helps, often quietly and without any public recognition.
And she certainly doesn't do it alone.
There's an entire organization of dedicated people working tirelessly to defend the rights of citizens and noncitizens alike.
Jenin herself probably works 80 hours a week serving a massive community across the country. I genuinely don't know how she does it, but I know that this kind of work takes an enormous personal toll.
The other side has ann entire army of lawyers and organizations. We have our own as well but we don’t know them or support them enough. People like Jenin spend their lives showing up for others. I think it's time we showed up for them.
ADC needs our support and resources to continue this important work and give people like Jenin the relief they deserve.
If you appreciate having people willing to stand up to government abuses, especially when ordinary people have nowhere else to turn, please consider supporting their work.
I'll leave a link below for anyone who wants to contribute. 👇

If true, this marks another escalation in the Zionist war against Americans and their civil liberties. Just the other day, @endthecartel26 was arrested and told he might be charged with a hate crime for using colorful language against Israel in public. Now, this Israel-critical mam has apparently been arrested for a social media post— almost always first amendment protected speech— based on accusations by two pro Israel women.
We @adc are fighting the Israel lobby’s attempts to decimate our civil liberties every day, but we don’t have enough attorneys to take on as many cases as I’d like. Please consider supporting our efforts if this is something you care about.
You can do so by going to Adc.org
A good friend of mine, @iElijahManley (ran for Congress against carpet bagger Wasserman Schultz) was just arrested and given a $40,000 bond for a social media post he made back in August.
Two women who are falsely claiming to be victims of the post (which had nothing to do with either of them) are major fundraisers for the Broward SA office.
These womens' social media posts are almost exclusively pro-Israel propaganda.
Elijah passionately spoke up against Israel throughout his campaign.

Forty-one years after Palestinian American civil rights leader Alex Odeh was assassinated in a bombing at his Santa Ana office, no one has been brought to justice for his murder.
In this report for Capitol Hill Citizen, Russell Mokhiber examines journalist David Sheen’s investigation into the killing, the suspects identified by investigators, and allegations that U.S. authorities were prevented from arresting them before they fled to Israel.
Odeh was a leader in the American-Arab Anti-Discrimination Committee who worked to build dialogue between Arab Americans and Jewish Americans. His assassination remains an open wound, and his family is still waiting for justice.

Heidi Levine, an American journalist, was on assignment for the Washington Post when she was beaten so badly by Israeli settlers that she needs surgery. No condemnation or even mention from the United States yet.

Israeli settlers, funded and protected by the United States, attacked this female American journalist in her sixties.

This video captures settlers beating Heidi. They clubbed her, kicked her. Pulled her up off the ground to beat her more. Robbed her of all her equipment. If she didn’t have a helmet—and if she was Palestinian—she could be dead.

The IDF provided cover, with tear gas and machine guns, while the settlers beat @washingtonpost journalist Heidi Levine nearly to death. Then the IDF shot a Palestinian bystander, and aimed their guns and shoved the paramedics who were trying to treat him. All of this documented.
Earlier today, IDF and Israel Border Police forces were dispatched to an area adjacent to Khirbet Abu Falah, following a report of a violent confrontation. Foreign media personnel were present at the scene and a female journalist was injured during the confrontation. All details of the incident will be examined. Upon arriving to the scene, the forces acted to disperse the confrontation using riot dispersal means.
At another location where the confrontation took place, IDF soldiers initially fired warning shots into the air and then fired toward a suspect who ran toward them, carrying a sharp object and posed a threat to them. The confrontation was dispersed.
Israeli Police forces and forensic investigators from the Judea and Samaria District will enter the area with IDF security to collect findings and evidence, as well as take testimonies.
Violence against innocent civilians is a grave and intolerable phenomenon that requires a coordinated, multi-agency response. The IDF will work together with the relevant authorities to eradicate this phenomenon.
The IDF strongly condemns this incident. Attempts to incite friction between populations undermine security in the area.

Palestinian American attorney Jalal “Jay” Shehadeh was detained for four hours by CBP at Newark Airport while returning from Palestine, where agents seized his phone.
ADC just secured the return of his phone through an emergency federal court motion.
Border searches of electronic devices are becoming increasingly common, raising serious questions about how much privacy and protection Americans retain when reentering their own country.

A majority of Americans now sympathize more with Palestinians than Israelis, but as ADC President and Legal Director @JeninYounesEsq points out, Washington hasn’t caught up with public opinion. Will the U.S. government ever change its policy toward Israel to reflect the will of the American people?

A four-month investigation by Declassified UK revealed that Jonathan Burman, a British national from Manchester, served in the Israeli military during the genocide in Gaza.
Images posted to his Instagram show Burman, linked to the 55th Reserve Paratrooper Brigade, in front of the burning Al-Farabi primary school in Khan Younis, an UNRWA facility previously used by displaced civilians.
Under the Geneva Convention, wanton destruction of property constitutes a war crime. With over 2,000 Britons having served in the Israeli army, UN commissioner Chris Sidoti stated the UK Met Police should investigate Burman.
60 Minutes interviewed Samed Khdair, a Palestinian American recently beaten by Israeli settlers and denied meaningful assistance by the U.S. Embassy. They cut his interview from the final broadast, and aired this instead.
The segment barely acknowledged Palestinians killed by Israeli settlers and failed to mention U.S. citizens killed— including Nasrallah Abu Siyam, Khamis Ayyad, and Sayfollah Musallet — all killed in the past year alone.
By airing such a watered-down piece, CBS gave viewers a grossly incomplete account of an issue that should matter deeply to Americans: how our citizens are treated by a state that receives billions of our taxpayer dollars and influences our foreign policy at the expense of our own interests.
These omissions make the violence appear less urgent and leave Washington’s failure to protect its own citizens without meaningful scrutiny. Lesley Stahl, CBS, and CBS News editor-in-chief Bari Weiss owe viewers the full story.
Another glaring example of the Palestine exception —and the erosion of journalistic standards at 60 Minutes.
